Terms of Service

SentryIntakeis a software service that answers inbound telephone calls on behalf of property-damage restoration businesses using an automated AI voice agent. It is designed to engage callers, gather a first notice of loss ("FNOL") — such as the cause and category of loss, service address, insurance carrier, policy and claim details, and contact information — produce call transcripts and summaries, and notify you (for example, by SMS) so that you can dispatch a crew.

The service is an intake and answering tool. It does not perform restoration work, dispatch crews on your behalf, or provide any emergency, medical, safety, legal, or insurance advice.

You must be at least 18 years old and authorized to enter into these Terms on behalf of the business you represent. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.

• Subscriptions. The service is offered on a recurring monthly subscription. Fees, plan limits, and features are described at the time of purchase.
• Payment processing. Billing is handled by our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring monthly basis until you cancel.
• Cancellation. You may cancel at any time, effective at the end of your current billing period. Your access continues through the period you have already paid for.
• Refunds. Except where required by applicable law, fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, or downgrades.
• Changes to fees. We may change our fees on a prospective basis. We will give you reasonable advance notice, and changes take effect at your next renewal.
• Taxes. Fees are exclusive of taxes, which are your responsibility where applicable.

You agree not to, and not to permit anyone to:

• Use the service for any unlawful, fraudulent, or deceptive purpose;
• Use the service in a manner that violates telemarketing, robocall, call-recording, or consumer-protection laws;
• Misrepresent your identity or your authority to use the service;
• Attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the service or its infrastructure;
• Upload or transmit malware, or use the service to harass, abuse, or harm others;
• Resell or provide the service to third parties except as expressly permitted in writing.

You retain ownership of the information and content captured through your use of the service, including call recordings, transcripts, and FNOL data ("Customer Data"). You grant us a limited license to process Customer Data to provide, secure, maintain, and improve the service. You represent that you have all rights and consents necessary for us to process Customer Data, including any personal information of third-party callers.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVERY CALL WILL BE ANSWERED OR CAPTURED ACCURATELY.

TO THE FULLEST EXTENT PERMITTED BY LAW, NEXTAI FORGE, LLC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST DATA, OR LOST OR MISSED JOBS, ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT OF FEES YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless NextAI Forge, LLCand its officers, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) Customer Data and your handling of FNOL information and caller communications; (c) your failure to obtain any legally required call-recording notice or consent; or (d) your violation of these Terms or applicable law.

We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the service in a way that risks harm to us, the service, or others. You may stop using and cancel the service at any time. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to other agreed dispute-resolution terms.
